Terms and Conditions
These Terms and Conditions (the “Terms”) apply to any travel products and/or services from The Gold Variety and govern the contractual relationship between you and The Gold Variety.

Please carefully read all the terms and conditions of this contract detailed below before booking with The Gold Variety (hereinafter, “Company”). For and in consideration for being permitted to participate in the experience you have selected with Company (the “Experience”), you agree to accept and be bound by the terms and conditions set forth herein. By booking any Product with The Gold Variety, or by traveling on a The Gold Variety experience you acknowledge that you: i) have read and understand these Terms, and ii) indicate your express acceptance of and agree to be bound by these Terms. If you have confirmed a booking by submitting a deposit on any Products on such booking via Wix, Zelle or Cashapp, you shall be deemed to have accepted these Terms on behalf of all clients named in the booking (including minors and those under a disability) and traveling on or otherwise participating in any Products (hereinafter “you”, the “Client(s)”), and by such travel or participation all passengers indicate their assent to these Terms. The client who confirmed the booking (via trip request form) is deemed to be the designated contact person for all other clients named in such booking. These Terms constitute the entire agreement between the Client and The Gold Variety with respect to the subject matter thereof and supersedes all prior agreements, representations, and understandings of the parties, written or oral. Please note this Terms & Conditions document is valid for all Travels organized in whole by The Gold Variety and not in conjunction with any other party or tour operator associated with a given trip.
THE BOOKING CONTRACT
A booking is confirmed and these Terms shall apply when The Gold Variety, or an authorized agent acting on The Gold Variety’s behalf, have received the applicable deposit from the Client, and the Client has received written confirmation from The Gold Variety regarding the booking. The Client confirming the booking must be no less than 18 years of age and agrees to provide full, complete, and accurate information as requested by The Gold Variety to confirm such booking. Any Client confirming a booking on any Products with more than one Client named and booked on such booking represents and warrants to The Gold Variety that: i) they have all requisite consents and authority to make such booking on behalf of all other Clients named on the booking and have communicated all necessary information to the other Clients in order for them to give free and fully informed authorization to do so; ii) the information that they are providing regarding all clients is complete and accurate, and they have obtained all necessary consents and permissions to share such information with The Gold Variety for the purposes of completing the booking; and iii) they will inform all other named Clients on the relevant booking of the applicability of these Terms to the booking and the Clients’ relationship with The Gold Variety. At any time before a booking is confirmed, The Gold Variety reserves the right to increase or decrease brochure prices of any Products. The Gold Variety reserves the right to decline any booking, in their sole discretion.
CONFIRMATION AND ITINERARY SUBJECT TO MODIFICATION
After the company receives your deposit, you will receive a confirmation email. Please contact us if you do not receive a confirmation email within five (5) business days of submitting your Deposit. Thereafter, we may send you, and you consent to receive, correspondence related to the Experience and the Company, including the itinerary for the Experience. Such itinerary is subject to change, and Company expressly reserves the right to modify any aspect of the itinerary at any time due to the availability of third-party vendors, weather conditions, local conditions, or other circumstances out of our control.
PAYMENTS
a) Total Payment. The Total Payment is due prior to the start date of the experience (the “Payment Due Date”). Please note the Payment Due Date may vary according to your experience; you will be notified of the payment schedule upon booking. If the company does not receive your total payment on or before the payment due date without payment schedule extension or refinancing request, the company may cancel your reservation, and you will forfeit your deposit and the amount paid thus far. Payment extensions will be honored in good faith that the Client will fulfill missed payments 60 days or more prior to departure for the experience they have submitted a deposit for. The full payment is non-refundable within 60 of departure, however, may be and transferred to another traveler. Payment is non-transferrable to a different experience or trip.
b) Deposit. Your Deposit is non-refundable and non-transferable to a different Experience or trip. You may request to have your deposit applied to another participant’s registration for the same Experience prior to the Payment Due Date; however, it will be your responsibility to find this participant. Without submission of the deposit, The Gold Variety maintains the right to assign your spot to the next eligible client on the waitlist without notice.
c) Late Payment: Failure to make a payment within ten days of the agreed-upon date is a breach of contract and may result in the cancellation of your experience. If you miss multiple payments or are having trouble making a payment, you must contact The Gold Variety or an authorized agent acting on The Gold Variety’s behalf to notify the Company of a potential late payment, and you may incur a late fee. Client is responsible for completing missed payments 60 days or more prior to departure for their selected experience.

RESPONSIBILITY
During the experiences that travelers participate in, clients hereby acknowledge and accept full responsibility for the following:

Personal Belongings and Decisions: Clients are fully responsible for the safekeeping of their belongings and any personal decisions made during the course of TGV managed trips.

Missed Flights, Reservations, or Activities: Clients bear the sole responsibility for any missed flights, reservations, or scheduled activities.

Property Host and Local Authorities: Clients are accountable for any damage fees, fines, or complaints made by property hosts or local authorities arising from their actions or conduct.

Rented Vehicles and Beach Equipment: Clients shall be liable for any damage incurred to rented vehicles or beach equipment during the course of the trip.

Compliance with Terms and Policies: Clients must strictly adhere to the terms and policy agreements outlined by TGV, property hosts, and vendors.

Rental Property Reset: Clients are obliged to reset rental properties at the end of their stay, including tasks such as removing trash, locking doors, and following check-out instructions provided by property hosts. Any fees resulting from a failure to leave a clean space or due to property/hotel accommodation damage shall be the exclusive responsibility of the travelers on the trip.

Full Payment: Clients are required to make full payment for all services, activities, and fees presented by TGV.

EXCLUSIONS GUIDELINES
TGV undertakes the coordination and booking of activities, accommodations, and services as listed on the "What's included" page. However, clients must independently arrange and cover the expenses for the following, as they are not included in the price estimate:

Flights or Transportation: Clients are responsible for arranging and covering the costs associated with flights or transportation required to reach the destination city.

Travel Insurance: Clients must secure their own travel insurance coverage.

Transportation Fees: Any fees incurred from using services such as Ubers, Lyfts, or taxis are not included in the price estimate.

Additional Rentals: All rentals, excluding accommodations, such as rental cars, bikes, or golf carts, are not included in the price estimate.

COVID Testing and Vaccinations: Costs related to COVID testing and vaccinations are not covered within the price estimate and must be borne by the clients.

By participating in TGV managed trips, clients confirm their understanding and acceptance of these responsibilities and exclusions. Failure to adhere to these terms may result in financial liability and legal action. TGV reserves the right to update or modify these terms without prior notice.

CANCELLATION BY THE CLIENT
Any cancellation of a booking and/or a Product by a Client must be delivered to The Gold Variety in writing and be acknowledged by The Gold Variety 75 days or more prior to intended departure. Up until bookings have been initiated (once deposit is fulfilled for all participants on the trip), clients can freely change their travel dates at their own risk (availability of certain activities, accommodations, etc are subject to change). However, once bookings have been confirmed, rebooking/cancellation policies provided by The Gold Variety, the accommodation hosts, service vendors and activity vendors will be applied. Client(s) that initiated the cancellation will be responsible for costs, regardless of attendance of the selected experience or itinerary item. The full balance due is non-refundable within 60 of departure, however, may be and transferred to another traveler.
Deposits are non-refundable and payment terms & policies apply. It is recommended that clients PURCHASE trip cancellation coverage. Trip cancellation insurance is the only means of receiving reimbursement for flights and other non-refundable expenses should you cancel your trip for any reason, whether voluntarily or as a result of The Gold Variety’s actions.
REFUNDS
You may cancel your participation in a The Gold Variety Experience, but please be aware of the following cancellation policy: It is a commitment to bring these experiences to our guests, and therefore the deposit is non-refundable, and ALL payments made towards the balance of your trip are non-refundable 7 days after the payment is made/due, including late fees, full payments, and installment payments. The ONLY exception to this policy is if the trip must be canceled in its entirety for any reason, in which case The Gold Variety will notify all parties via email and provide refund instructions. Unforeseen situations may present themselves to our guests, and for those circumstances, situations, and occasions, we HIGHLY recommend that you purchase Travel Insurance to cover your assets. The Gold Variety is not responsible for any incidental expenses or consequential losses that the Client may have incurred as a result of the canceled booking, such as visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment, etc. Clients purchasing Products are highly recommended to purchase comprehensive cancel for any reason insurance, to the extent such insurance is available under the laws governing each client’s country of origin. For Vendors: If at any point a booking on the "what's included" page is canceled by the vendor/host or cannot be completed by the vendor/host due to unforeseen circumstances, we will work with the POC to ensure travelers are fully reimbursed for the price of that booking, or, The Gold Variety will replace the cost of that activity/accommodation with another selection of the same category and quality.
WHY IS MY PAYMENT NONREFUNDABLE?
Our vendor(s) — hotels, guest speakers, excursion companies, etc. — require upfront commitments that we must adhere to. By submitting a deposit, the Client is securing their spot on the trip, and therefore is accounted for in all itinerary bookings and charges incurred by The Gold Variety. When we offer a package to you, we have to ensure, through good-faith payments, that you will attend the retreat.
UNUSED SERVICES
The Gold Variety shall not offer or pay any discounts or refunds for missed or unused services which were missed or unused by the Client due to no fault of The Gold Variety or its Experience Designers, which shall include any termination of the Client’s participation in the tour Product due to the Client’s own fault, negligence or breach of these Terms.
PHOTOS AND MARKETING
You agree to allow The Gold Variety to use images of you taken during the Experience for advertising and promotional purposes in any medium we choose. You grant The Gold Variety a perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes.
EXCLUSION OF LIABILITY
The Gold Variety is not responsible for any bodily injury or harm or damage to any property incurred by you as a result of participating in a The Gold Variety Experience. In case of accidents, injury, or illness, The Gold Variety shall not be responsible for any costs or expenses associated with such events, including but not limited to medical expenses, repatriation expenses, loss of or damage to personal property, and any other damages or costs. You are responsible for all such costs and expenses and you agree to indemnify and hold The Gold Variety harmless from and against all claims, losses, liabilities, and expenses arising out of any such events.
FORCE MAJEURE
The Gold Variety is not responsible for any failure to comply with these Terms or for any failure to provide or perform services as a result of any event beyond its control, including without limitation any fire, flood, earthquake, elements of nature or acts of God, acts of war, terrorism, riots, civil disorders, rebellions, revolutions, insurrections, strikes, lockouts, or labor disputes or other labor problems, accidents, disease, pandemics, epidemics, outbreaks, and government actions, regulations, orders or directives. If any of these events occur, The Gold Variety reserves the right to cancel or modify the itinerary and to cancel or modify any of the bookings, orders, payments, or reservations made in connection therewith without any liability to you. The Gold Variety shall not be responsible for or required to refund any portion of the price paid by any client as a result of the events described in this paragraph.
TRAVEL INSURANCE
We require all of our travelers to purchase trip insurance. Your trip insurance must include coverage for trip cancellation and interruption, travel delay, baggage delay, medical expenses, and emergency evacuation/repatriation. Proof of insurance must be provided to The Gold Variety prior to your Experience. You are solely responsible for the cost of the insurance.

CLIENT RESPONSIBILITY
It is your responsibility to select an Experience appropriate to your abilities and interests. You are responsible for preparing for the Experience by studying the itinerary and pre-departure information sent by The Gold Variety, and for bringing the appropriate clothing and equipment as advised therein.

ASSUMPTION OF RISK
You understand and acknowledge that your participation in the Experience may involve physical activity and may carry with it inherent risks of physical injury, including death. You hereby voluntarily assume all inherent and other risks of injury, including death, that may result from your participation in the Experience.
SEVERABILITY
If any provision of these Terms is found by any court or other competent authority to be void or unenforceable in whole or part, the other provisions of these Terms and the remainder of the affected provisions shall continue to be valid.
GOVERNING LAW
These Terms and Conditions shall be governed by and construed in accordance with the laws of the United States of America. Any dispute, controversy, or claim arising out of or relating to these Terms and Conditions, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the competent courts of the United States of America.
By confirming a booking with The Gold Variety, the Client acknowledges that they have read, understand, and voluntarily agree to these Terms and Conditions, and hereby authorize The Gold Variety to charge their credit card for the deposit amount.
